Algemene voorwaarden voor fotografen

1. Taal en vertalingen

Deze algemene voorwaarden voor fotografen zijn beschikbaar in verschillende talen. De Engelse versie is in het algemeen leidend en juridisch bindend. Vertalingen worden verstrekt ter wille van de duidelijkheid. Wanneer Contrima uitdrukkelijk een andere juridisch bindende versie aanwijst voor individuele licentieovereenkomsten of productgerelateerde processen, blijft dit onverlet. Dwingende wettelijke bepalingen, in het bijzonder bepalingen inzake consumentenbescherming van het land waar de betrokkene zijn gewone verblijfplaats heeft, blijven onverlet.

2. Toepassingsgebied en verhouding tot andere voorwaarden

Deze Algemene Voorwaarden voor Fotografen zijn van toepassing naast de Algemene Gebruiksvoorwaarden en het Privacybeleid van Contrima voor alle geregistreerde fotografen, die Contrima gebruiken voor het beheer, de levering, publicatie, documentatie, of exploitatie van fotografische inhoud.

Ze regelen met name de fotografespecifieke verplichtingen met betrekking tot: foto's, uploads, toegang voor deelnemers, galerijen, overeenkomstprocessen, openbare weergave, opslag en eventuele verkoopfuncties.

Wanneer aanvullende voorwaarden van toepassing zijn op specifieke functies, in het bijzonder op verkoop, betalingen, uitbetalingen of gekoppelde betalingsdiensten, moeten deze afzonderlijk in acht worden genomen. In geval van tegenstrijdigheid hebben deze Voorwaarden voor fotografen voorrang boven de Algemene gebruiksvoorwaarden

3. Fotograafaccount, gegevens en toegangsbeveiliging

Fotografen zijn verplicht om bij registratie en tijdens het gebruik waarheidsgetrouwe, volledige en actuele informatie te verstrekken, voor zover dit nodig is voor het gebruik van Contrima.

Toegangsgegevens en andere authenticatiegegevens moeten vertrouwelijk worden behandeld en worden beschermd tegen ongeoorloofde toegang. De fotograaf moet Contrima onmiddellijk op de hoogte stellen, indien er aanwijzingen zijn voor misbruik van het account of een inbreuk op de toegangsgegevens.

De fotograaf mag zijn account alleen in eigen naam gebruiken of namens een door Contrima uitdrukkelijk geautoriseerde organisatie-eenheid. Ongeautoriseerde overdracht van het account aan derden is verboden.

4. Persoonlijke verantwoordelijkheid voor afbeeldingen, uploads en rechten

De fotograaf is persoonlijk verantwoordelijk voor het waarborgen dat het maken, opslaan, selecteren, uploaden, ter beschikking stellen, publiceren, licentiëren en ander gebruik van de door hem gebruikte inhoud wettelijk is toegestaan.

De fotograaf mag alleen inhoud uploaden of gebruiken binnen Contrima, op voorwaarde dat hij daartoe bevoegd is en geen rechten van derden worden geschonden, in het bijzonder geen persoonlijkheidsrechten, portretrechten, auteursrechten, naburige rechten, merkrechten, gegevensbeschermingsrechten of andere intellectuele eigendomsrechten.

Contrima biedt technische processen voor contact, toegang, documentatie, toestemming, aankoop of goedkeuring, maar voert geen algemene juridische beoordeling van individuele gevallen uit en garandeert evenmin dat het gebruik in individuele gevallen wettelijk toegestaan is. Een eventuele latere verklaring via Contrima vervangt niet automatisch een eerder ontbrekende rechtsgrondslag.

5. Portretten, gevallen van afbeelding en gevoelige situaties

De fotograaf mag Contrima alleen gebruiken voor foto's waarop herkenbare personen staan, voor zover de daarvoor benodigde rechten, toestemmingen, goedkeuringen of andere rechtsgrondslagen aanwezig zijn, of door de fotograaf rechtsgeldig kunnen worden ingeroepen.

Wanneer verklaringen worden afgelegd namens minderjarigen of andere personen die niet bevoegd zijn om zelf verklaringen af te leggen,

In herkenbaar gevoelige situaties, met name waarbij kinderen en jongeren betrokken zijn, of in intieme, privé-, gezondheids-, religieuze of andere situaties die bijzonder gevoelig zijn in het kader van de wetgeving inzake gegevensbescherming, is bijzondere terughoudendheid geboden. Contrima heeft het recht om het gebruik van dergelijke inhoud te beperken of te blokkeren of om aanvullend bewijs te vragen.

6. QR-codes, toegang voor deelnemers, galerijen en goedkeuringsprocessen

Contrima kan QR-codes, toegangstokens, permanente links, toegang tot galerijen en vergelijkbare technische toegangssystemen aanbieden. Deze dienen uitsluitend ter vergemakkelijking van de technische toegang, de toewijzing van opdrachten en de uitvoering van galerij-, toestemmings-, aankoop- en documentatieprocessen.

De fotograaf blijft verantwoordelijk voor het waarborgen dat zaken, deelnemers, inhoud, galerijen, goedkeuringen, aankoopopties en andere opdrachten op een feitelijk correcte manier worden aangemaakt, toegewezen en gebruikt.

Voor zover Contrima processen aanbiedt voor het verkrijgen van verklaringen, voor het documenteren van toestemmingen of voor het creëren van bewijs, wordt dit aangeboden als technische infrastructuur. De verantwoordelijkheid van de fotograaf voor de rechtsgeldigheid van zijn specifieke handelingen blijft onverminderd van kracht.

7. Uploaden, technische verwerking, actieve opslag en archivering

Contrima heeft het recht om geüploade inhoud technisch op te slaan, te verwerken, om te zetten in varianten, voorbeeldafbeeldingen en watermerken te genereren, bestanden voor te bereiden voor galerijen en documentatiedoeleinden, en inhoud te beheren in de actieve opslag en in het archief in overeenstemming met het betreffende product-, opslag- en levenscyclusmodel.

De fotograaf erkent dat: regels inzake opslag, quota, archivering en levenscyclus door Contrima kunnen worden beheerd in overeenstemming met het respectieve geboekte model. Dit kan met name het volgende omvatten: uploadblokkades wanneer quota zijn opgebruikt, de overdracht van oudere inhoud naar archiefopslag, het verwijderen van conceptbestanden die nooit zijn afgerond, evenals de afzonderlijke opslag van audit- en documentatiegegevens.

8. Openbare weergave op Contrima

Voor zover inhoud of zaken binnen Contrima uitdrukkelijk zijn goedgekeurd voor openbare weergave en de benodigde rechten of toestemmingen aanwezig zijn, kunnen deze, binnen het kader van de respectievelijke geactiveerde productfuncties, verschijnen in het profiel of portfolio van de fotograaf, in de showcase van de fotograaf, in openbaar toegankelijke galerijweergaven, of in andere openbare weergaven die hiervoor op Contrima zijn voorzien.

De fotograaf mag een dergelijke openbare weergave alleen activeren of regelen, indien hij daartoe in het betreffende geval wettelijk gerechtigd is. Dit geldt ook indien Contrima de technische middelen voor openbare publicatie ter beschikking stelt.

9. Downloads, externe kopieën, intrekking en latere beperkingen

De fotograaf erkent dat,

In geval van een latere herroeping, bezwaar, of enige andere wettelijke beperking, zal Contrima de verdere terbeschikkingstelling, openbare vertoning en ander door Contrima gecontroleerd gebruik via het platform voor de toekomst stopzetten of beperken voor zover dit wettelijk vereist is.

Contrima is niet aansprakelijk voor onafhankelijk gebruik door de gefotografeerde persoon, de fotograaf of derden buiten Contrima, op voorwaarde dat Contrima geen van haar eigen verplichtingen heeft geschonden. De fotograaf blijft in elk afzonderlijk geval verantwoordelijk voor de beslissing om inhoud aan te bieden, te leveren, openbaar weer te geven of te verkopen.

10. Klachten, inbreuken en medewerkingsverplichtingen

Indien Contrima meldingen ontvangt van mogelijke inbreuken, onwettige inhoud, onjuiste bronvermeldingen, ongeldige verklaringen of andere klachten in verband met een zaak, is de fotograaf verplicht om in redelijke mate mee te werken, in het bijzonder om informatie te verstrekken, documenten in te dienen, bronvermeldingen te controleren, en redelijke correcties aan te brengen.

Contrima heeft het recht om: de betreffende inhoud, toegang, galerijen, publicaties, aankoopopties of uitbetalingen tijdelijk te beperken, te deactiveren of te blokkeren totdat de zaak is opgehelderd.

11. Abonnementen, kosten, verkopen en aanvullende voorwaarden

Het gebruik van bepaalde Contrima-functies kan afhankelijk zijn van een proefaccount, een geabonneerd abonnement, extra opslagpakketten of andere geactiveerde servicecomponenten. De voorwaarden die worden weergegeven in de aanbieding, in het account of tijdens het bestelproces zijn van toepassing.

Wanneer Contrima functies voor verkoop, betalingen of uitbetalingen aanbiedt, zijn ook de relevante algemene voorwaarden van de verkoper, uitbetalings- en betalingsdienstverlener van toepassing. Contrima heeft het recht om: aanvullende identiteits-, bedrijfs-, fiscale, bank- of verificatiegegevens voor dergelijke functies op te vragen en het gebruik van dergelijke functies te beperken totdat volledige en succesvolle activering heeft plaatsgevonden.

12. Platforminterventies, beperkingen en beëindiging

Contrima heeft het recht om: accounts, inhoud, publicaties, galerijen, verkoopfuncties, toegang of individuele technische functies, geheel of gedeeltelijk, te beperken, op te schorten of te beëindigen, indien daar een objectieve reden voor is. Dit geldt in het bijzonder voor wetsovertredingen, specifieke gevallen van verdenking, veiligheidsrisico's, gebrek aan bewijs, betalingsproblemen, wettelijke vereisten of schendingen van deze Voorwaarden voor Fotografen, de Algemene Gebruiksvoorwaarden of aanvullende Verkopers- en Betalingsvoorwaarden.

13. Vrijwaring

De Fotograaf vrijwaart Contrima tegen alle vorderingen van derden, opslag, terbeschikkingstelling, publicatie, licentieverlening, verkoop of ander gebruik van inhoud waarvoor de Fotograaf verantwoordelijk is, met inbegrip van redelijke kosten voor juridische verdediging, op voorwaarde dat Contrima zelf niet verantwoordelijk is voor de inbreuk.

Dit geldt in het bijzonder voor inbreuken op beeldrechten, persoonlijkheidsrechten, gegevensbeschermingsrechten, auteursrechten, merkrechten, in geval van onjuiste weergavegegevens, in geval van ongeoorloofde openbaarmaking, of in geval van andere onrechtmatige uitspraken of handelingen van de fotograaf.

Photographer terms and conditions

1. Language and translations

These Photographer Terms and Conditions are provided in several languages. The English version is generally authoritative and legally binding. Translations are provided for the sake of clarity. Where Contrima expressly designates a different legally binding version for individual licence agreements or product-related processes, this remains unaffected. Mandatory statutory provisions, in particular consumer protection provisions of the country of habitual residence of the data subject, remain unaffected.

2. Scope and Relationship to Other Terms

These Photographer Terms and Conditions apply in addition to Contrima’s General Terms of Use and Privacy Policy for all registered photographers, who use Contrima for the management, provision, publication, documentation, or exploitation of photographic content.

In particular, they govern photographer-specific obligations in connection with: photographs, uploads, participant access, galleries, agreement processes, public display, storage and any sales functions.

Where additional terms apply to specific functions, in particular to sales, payments, payouts or linked payment services, these must be observed separately. In the event of any conflict, these Photographer Terms shall take precedence over the General Terms of Use

3. Photographer Account, Details and Access Security

Photographers are obliged, upon registration and during ongoing use, to provide true, complete and up-to-date information, insofar as this is necessary for the use of Contrima.

Access data and other authentication details must be treated as confidential and protected against unauthorised access. The photographer must inform Contrima immediately, if there are indications of misuse of the account or a compromise of the access data.

The photographer may only use their account in their own name or on behalf of an organisational unit expressly authorised by Contrima. Unauthorised transfer of the account to third parties is prohibited.

4. Personal responsibility for images, uploads and rights

The photographer is personally responsible for ensuring that the creation, storage, selection, upload, provision, publication, licensing and other use of the content they use are legally permissible.

The photographer may only upload content or use it within Contrima, if they are authorised to do so and no third-party rights are infringed, in particular no personal rights, image rights, copyright, neighbouring rights, trademark rights, data protection rights, rights of minors or other intellectual property rights.

Insofar as content relates to places, rooms, plots of land, buildings, private locations, objects, projects, animals or other depicted contexts, the photographer remains responsible for ensuring that the necessary rights, permissions, rights of access, owner’s rights, operator’s rights or other authorisations are in place in the specific case. Declarations made via Contrima cover such contexts only within the scope of the declarant’s actual authorisation.

Contrima provides technical processes for contact, access, documentation, consent, approval, purchase or agreement, but does not undertake a general legal review of individual cases nor does it guarantee that use is legally permissible in individual cases. Any subsequent declaration via Contrima does not automatically replace a previously lacking legal basis.

5. Portraits, depicted contexts, cases of representation and sensitive situations

The photographer may use Contrima for photos featuring recognisable persons only to the extent that the necessary rights, permissions, consents or other legal bases are in place for this purpose, or can be legally invoked by the photographer.

Declarations made on behalf of a person depicted or represented do not automatically cover: rights to locations, rooms, properties, objects, projects or other depicted contexts, unless the person making the declaration is specifically authorised to do so.

Where declarations are made on behalf of minors or other persons not authorised to make declarations themselves, the photographer is responsible for ensuring that the declarations are made by a person authorised to do so and that the underlying relationships of representation are accurate.

In recognisably sensitive situations, particularly involving children and young people, or in intimate, private, health-related, religious or other situations that are particularly sensitive under data protection law, particular restraint is required. Contrima is entitled to restrict the use of such content, block it or request additional evidence.

6. QR codes, participant access, galleries and agreement processes

Contrima may provide QR codes, access tokens, permanent links, gallery access and comparable technical access systems. These serve exclusively to facilitate technical access, the allocation of cases, and the execution of gallery, consent, purchase and documentation processes.

The photographer remains responsible for ensuring that cases, participants, parties involved, content, galleries, approvals, purchase options and other assignments are created, assigned and used in a factually correct manner.

Where the Photographer uses purchase or licence options in cases involving minors, they remain responsible for creating and using these cases in such a way that the necessary declarations, parental consents and payment authorisations can be obtained from legal guardians or other adults authorised to act on their behalf. Minors must not be specifically guided through purchase or licence processes in order to circumvent the necessary parental consents.

Where Contrima provides processes for obtaining declarations, for documenting consents or for generating evidence, this is provided as technical infrastructure. The photographer’s responsibility for the legal validity of their specific course of action remains unaffected.

7. Upload, technical processing, active storage and archive

Contrima is entitled to technically store uploaded content, process it, convert it into variants, generate preview images and watermarks, prepare files for galleries and documentation purposes, and manage content in active storage and in the archive in accordance with the respective product, storage and lifecycle model.

The photographer acknowledges that: storage, quota, archiving and lifecycle rules may be controlled by Contrima in accordance with the respective model booked. This may include, in particular, upload blocks when quotas are exhausted, the transfer of older content to archive storage, the deletion of draft files that were never finalised, as well as the separate storage of audit and documentation data.

Archived content may only be available to a limited extent, with a time delay, or only following technical recovery processes. Contrima does not guarantee immediate availability of archived original files at all times, unless this has been expressly agreed.

8. Public display on Contrima

Insofar as content or cases within Contrima are expressly approved for public display and the necessary rights or permissions are in place, these may appear, within the scope of the respective activated product functions, in the photographer’s profile or portfolio, in the photographer’s showcase, in publicly accessible gallery views, or in other public displays provided for this purpose on Contrima.

The photographer may only activate or arrange such public display, if they are legally entitled to do so in the respective case. This also applies if Contrima provides the technical means for public release.

9. Downloads, external copies, revocation and subsequent restrictions

The photographer acknowledges that, once delivery has taken place or following a download, Contrima is under no technical obligation to recall copies already downloaded outside the platform, to delete them or to effectively prevent their further use.

In the event of subsequent revocation, objection or any other legal restriction, Contrima shall cease or restrict, to the extent required by law, the continued provision, public display and other uses controlled by Contrima via the platform for the future.

Contrima shall not be liable for independent use by the photographed person, the recipient, the buyer, the photographer or third parties outside Contrima, provided that Contrima has not breached any of its own obligations. The photographer remains responsible for the decision to provide, deliver, publicly display or sell content in each individual case.

10. Complaints, infringements and obligations to cooperate

If Contrima receives reports of possible infringements, unlawful content, incorrect attributions, invalid declarations, or other complaints in connection with a case, the photographer is obliged to, cooperate to a reasonable extent, in particular to provide information, submit documents, to review attributions, and to make reasonable corrections.

Contrima is entitled to, temporarily restrict, deactivate or block affected content, access, galleries, publications, purchase options or payouts until the matter has been clarified.

11. Plans, Fees, Sales and Additional Terms

The use of certain Contrima features may depend on a trial account, a subscribed plan, additional storage packages or other activated service components. The terms and conditions displayed in the offer, in the account or during the ordering process shall apply.

Where Contrima provides functions for sales, payments or payouts, the relevant seller, payout and payment service terms and conditions shall also apply. Contrima is entitled to request additional identity, company, tax, bank or verification data for such functions and to restrict the use of the relevant functions until full and successful activation has taken place.

In cases involving minors or legal representation, sales, payment, activation or delivery functions may additionally be made conditional upon the provision of the necessary representative approval, payment authorisation or other suitable proof.

Where digital images or digital usage rights are provided for a fee, Contrima may make the start of the payment process, activation, delivery or download conditional upon the purchaser or authorised representative expressly consenting to such provision before the expiry of the statutory withdrawal period and confirming that the right of withdrawal expires upon commencement of the provision. The photographer remains responsible for ensuring that their offers and communications are not designed in a way that circumvents or misrepresents this confirmation.

12. Platform Interventions, Restrictions and Termination

Contrima is entitled to: restrict, suspend or terminate accounts, content, publications, galleries, sales functions, access or individual technical functions, in whole or in part, if there is an objective reason for doing so. This applies in particular to legal violations, specific cases of suspicion, security risks, lack of evidence, payment issues, regulatory requirements or breaches of these Photographer Terms and Conditions, the General Terms of Use or additional Seller and Payment Terms.

Following the termination of the account or individual functions, data and documentation required by law, necessary for record-keeping, or required to defend against claims may continue to be stored in accordance with legal requirements.

13. Indemnification

The Photographer shall indemnify Contrima against all claims by third parties, storage, provision, publication, licensing, sale or other use of content for which the Photographer is responsible, including reasonable legal defence costs, provided that Contrima is not itself responsible for the infringement.

This applies in particular to infringements of image rights, personal rights, data protection rights, copyrights, trademark rights, property rights, or the rights of owners or operators, in the event of inaccurate representation details, unauthorised public releases, inaccurate location, property or project approvals, or in the event of other unlawful statements or actions by the photographer.
