Contrima je posvećena zaštiti tvoje privatnosti. Sljedećim obavijestima pružamo ti informacije o obradi osobnih podataka od strane Contrima. Ove obavijesti o zaštiti podataka izričito se odnose na procese obrade podataka koji se tiču fotografa koji su naši pretplatnici ili to žele postati. One nadopunjuju naše opće obavijesti o zaštiti podataka koje možeš pronaći na sljedećem linku: Opća pravila privatnosti.

Ove obavijesti o zaštiti podataka informiraju te u skladu s čl. 12 i dalje GDPR-a o postupanju s tvojim osobnim podacima kada kreiraš račun kod nas ili ga već imaš. Posebno objašnjavaju koje podatke prikupljamo i za što ih koristimo. Također te informiramo kako i u koju svrhu se to događa.
Tvoje osobne podatke obrađujemo u skladu s čl. 6 st. 1 GDPR-a, tj. za obradu tvojih osobnih podataka imamo ili tvoju privolu ili postoji druga zakonska pravna osnova. Također surađujemo s pružateljima usluga koji za nas obrađuju tvoje osobne podatke (npr. hosting web stranice CONTRIMA).
Osobni podaci su sve informacije koje se odnose na identificiranu ili prepoznatljivu fizičku osobu (u daljnjem tekstu „ispitanik“); fizička osoba koja se može identificirati je ona koja se može identificirati izravno ili neizravno, posebno dodjeljivanjem identifikatora kao što su ime, identifikacijski broj, podaci o lokaciji, online identifikator ili jedan ili više posebnih obilježja koji su izraz fizičkog, fiziološkog, genetskog, psihičkog, ekonomskog, kulturnog ili socijalnog identiteta te fizičke osobe (vidi čl. 4 br. 1 GDPR-a). Osobni podaci su stoga i podaci koji se mogu povezati s osobom kao što je IP adresa. Osim toga, mogu uključivati: oslovljavanje, ime, prezime, naziv radnog mjesta, e-mail adresu, tvrtku, ulicu, poštanski broj i mjesto.
Obrada je svaki postupak ili niz postupaka koji se provode s osobnim podacima, bilo automatiziranim sredstvima ili ne, kao što su prikupljanje, bilježenje, organizacija, strukturiranje, pohrana, prilagodba ili izmjena, dohvaćanje, konzultacija, uporaba, otkrivanje prijenosom, širenje ili drugačije stavljanje na raspolaganje, usklađivanje ili kombiniranje, ograničavanje, brisanje ili uništavanje (vidi čl. 4 br. 2 GDPR-a).
Za korištenje platforme CONTRIMA i usluga koje ona obuhvaća nudimo mogućnost kreiranja korisničkog računa povezanog s tvojom e-mail adresom. Tada se akcije koje se izvode na web stranici mogu povezati s tim računom. Da bi se proces registracije mogao provesti i završiti, potrebno je unijeti sljedeće osobne podatke: ime, prezime, e-mail adresu.
Pravna osnova za obradu podataka je korisnički odnos koji nastaje registracijom (čl. 6 st. 1 b) GDPR-a). Dostavljanje tvojih podataka je potrebno za registraciju, jer inače ne može biti kreiran korisnički račun povezan s tobom. Tvoji podaci će biti pohranjeni za vrijeme trajanja korisničkog odnosa i eventualnih obveza čuvanja.
Da bi koristio ponude platforme CONTRIMA, možeš sklopiti pretplate (Personal, Professional) ili prvo kliknuti na probni pristup.
Prilikom sklapanja pretplate tražimo razne dodatne podatke od tebe, uključujući posebno adresne, fakturacijske i podatke o plaćanju. Koristimo ih za pružanje pretplate i naplatu. Obrada podataka je zakonski dopuštena za izvršenje ugovora koji se sklapa (čl. 6 st. 1 lit. b GDPR-a). Dostavljanje podataka koje tražimo je potrebno za sklapanje pretplate. Tvoj podatkovni zapis će biti pohranjen u našoj bazi podataka za vrijeme trajanja pretplate. Daljnje pohranjivanje se vrši samo radi ispunjavanja zakonskih obveza čuvanja.
U slučaju probnog pristupa, obrada podataka koje tražimo je dopuštena za ispunjenje ugovora koji se sklapa kao i za zaštitu naših legitimnih interesa (čl. 6 st. 1 b), f) GDPR-a). Dostavljanje tvojih podataka je dobrovoljno, ali je potrebno za pružanje naše ponude.
U tvom korisničkom računu informiramo te o novim informacijama o tvojim projektima i kolekcijama (npr. obavijest da su sva potraživanja izvršena ili da je stigla povratna informacija od osobe na slici). Pravna osnova za to je čl. 6 st. 1 b GDPR-a.
Komuniciramo s tobom u marketinške svrhe putem e-maila na temelju tvoje dane, u svakom trenutku opozive privole. Za to koristimo tvoje profilne podatke, posebno tvoju e-mail adresu koju si unio prilikom registracije. Svrha slanja e-mailova je predstavljanje novih funkcionalnosti i informiranje o novostima naše ponude usluga. Svoju privolu za obradu tvojih podataka u vezi s ovdje opisanim obavijestima možeš u svakom trenutku opozvati s učinkom za budućnost u postavkama svog korisničkog računa, tako da više nećeš primati poruke.
Za obradu plaćanja (npr. za pretplatu) koristimo pružatelja usluga plaćanja Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, D02 H210, Dublin, Irska (u daljnjem tekstu: „Stripe“). Prilikom sklapanja pretplate koja se plaća, podaci potrebni za plaćanje (npr. e-mail adresa, podaci o plaćanju ili računu) izravno se prenose Stripeu i tamo obrađuju. Koje su metode plaćanja dostupne, ovisi o opcijama koje Stripe nudi i koje je CONTRIMA omogućila. Napomena: Sami ne pohranjujemo bankovne podatke u našim sustavima. Samo bilježimo koji iznosi trebaju biti plaćeni i jesu li podmireni.

Ako izvršiš plaćanje kreditnom karticom, bit ćeš zatražen da uneseš podatke o plaćanju (e-mail adresa, podaci o kreditnoj kartici). Podaci se izravno prenose Stripeu s ID-om transakcije i tamo obrađuju. Od Stripea primamo samo potvrdu o izvršenom plaćanju kao i podatke potrebne za povezivanje plaćanja s tvojim računom.
Ovisno o odabranoj metodi plaćanja, podaci potrebni za izvršenje plaćanja (posebno tvoje ime, adresa za fakturiranje i eventualno dostavu, tvoja e-mail adresa, iznos koji treba platiti i detalji narudžbe kao i tvoja IP adresa (za prevenciju prijevara i geolokaciju)) također se prenose odgovarajućem pružatelju usluga plaćanja ili drugim stranama uključenim u obradu plaćanja. Imaj na umu da ti pružatelji usluga mogu obrađivati osobne podatke i u zemljama izvan EU ili EEA. Ti pružatelji oslanjaju se na odgovarajuće garancije za takve prijenose podataka, kao što su obvezujuća interna pravila o zaštiti podataka ili standardne ugovorne klauzule, a dodatno su pružatelji usluga certificirani prema EU-U.S. Data Privacy Framework.
Pravo na povlačenje: Privolu za obradu osobnih podataka prema čl. 6 st. 1 S. 1 lit. a) GDPR-a možeš u svakom trenutku povući. Imaj na umu da povlačenje vrijedi samo za budućnost. Pravo na prigovor: Imaš pravo, prema uvjetima čl. 21 GDPR-a, dakle kod obrada iz legitimnog interesa prema čl. 6 st. 1 lit. f GDPR-a, uložiti prigovor na obradu tvojih osobnih podataka, tako da moramo prekinuti obradu tvojih osobnih podataka. Pravo na prigovor postoji samo u granicama predviđenim čl. 21 GDPR-a. Osim toga, naši interesi mogu biti protiv prekida obrade, tako da smo unatoč tvom prigovoru ovlašteni obrađivati tvoje osobne podatke. Prigovor na eventualne mjere izravnog marketinga ćemo odmah uzeti u obzir bez ponovnog vaganja postojećih interesa.
Informacija o tvom pravu na prigovor prema čl. 21 GDPR-a: Imaš pravo u svakom trenutku uložiti prigovor na obradu tvojih podataka koja se temelji na čl. 6 st. 1 S. 1 lit. f GDPR-a (obrada podataka na temelju procjene interesa) ili čl. 6 st. 1 S. 1 lit. e GDPR-a (obrada podataka u javnom interesu), ako za to postoje razlozi koji proizlaze iz tvoje posebne situacije. Imaš pravo zatražiti od nas potvrdu obrađujemo li osobne podatke koji se odnose na tebe. Ako je to slučaj, imaš pravo na pristup tim osobnim podacima u zakonskom opsegu (čl. 15 GDPR-a u vezi s § 34 BDSG).
Također imaš pravo zatražiti ispravak netočnih osobnih podataka koji se odnose na tebe i, ako je potrebno – uzimajući u obzir svrhe obrade – dovršavanje nepotpunih osobnih podataka, također putem dodatne izjave (članak 16 GDPR-a).
U slučajevima navedenim u članku 17 st. 1 lit. a do f GDPR-a, također imaš pravo na brisanje osobnih podataka, osim ako ne postoji iznimka prema članku 17 st. 3 GDPR-a, kao i u slučajevima članka 18 st. 1 GDPR-a pravo na ograničenje obrade.
U slučajevima članka 20 st. 1 GDPR-a, također postoji pravo na prenosivost podataka.

This privacy notice expressly relates to data processing operations that photographers who are, or wish to become, our subscription customers. This privacy notice informs you, in accordance with Article 12 et seq. of the GDPR, about the handling of your personal data when you create an account with us or already have one. In particular, it explains what data we collect and for what purpose we use it. We also inform you about how and for what purpose this is done.
We process your personal data in accordance with Article 6(1) of the GDPR, i.e. for the processing of your personal data, we either have your consent or there is another legal basis for doing so. We also work with service providers who process your personal data on our behalf (e.g. hosting the CONTRIMA website).
Personal data is any information relating to an identified or identifiable natural person (hereinafter referred to as the ‘data subject’) ; a natural person is considered to be identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more specific characteristics that reflect the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person (see Article 4(1) of the GDPR). Personal data therefore includes data that can be linked to an individual, such as an IP address. Other examples include: title, first name, surname, job title, email address, company, street, postcode and town.
Processing means any operation or set of operations, whether or not carried out by automated means, performed on personal data data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction (see Article 4(2) of the GDPR).
To use the CONTRIMA platform and the services it provides, we offer the option to create a user account linked to your email address. The actions carried out on the website can then be attributed to this account. In order to complete the registration process, you must provide the following personal data: first name and surname, email address.
The legal basis for data processing is the user relationship established upon registration (Article 6(1)(b) of the GDPR). The provision of your data is therefore necessary for registration, as otherwise a user account associated with you cannot be created. Your data will be stored for the duration of the user relationship and in accordance with any applicable retention obligations.
To use the services offered by the CONTRIMA platform, you can take out a subscription (Personal, Professional) with us or first sign up for a trial account.
When taking out a subscription, we will ask you for various additional details, including, in particular, address, billing and payment details. We use these to provide the subscription and to invoice you. Data processing is permitted by law for the purpose of fulfilling the contract entered into (Article 6(1)(b) of the GDPR). The provision of the data we request is necessary to take out the subscription. Your data record will be stored in our database for the duration of the subscription. Any storage beyond this period is solely for the purpose of complying with the statutory retention obligations to which we are subject.
In the case of a trial subscription, the processing of the data we request is permitted for the purpose of fulfilling any contracts entered into and to safeguard our legitimate interests (Article 6(1)(b) and (f) of the GDPR). Providing your data is voluntary, but is required for the provision of our service.
In your user account, we will keep you informed of new information regarding your projects and collections (such as notification that all claims have been resolved or that a response has been received from a person depicted). The legal basis for this is Article 6(1)(b) of the GDPR.
Based on the consent you have given, which may be withdrawn at any time, we also communicate with you via email for marketing purposes. For this, we use your profile data, in particular the email address you provided during registration. The purpose of the sending of emails is to introduce you to new features and to inform you about updates to our range of services. You may withdraw your consent to the processing of your data in connection with the notifications described here at any time, with effect for the future, in the settings of your user account, so that you will no longer receive any messages.
To process payments (such as for a subscription), we use the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, D02 H210, Dublin, Ireland (hereinafter: ‘Stripe’). When you take out a paid subscription, the data required for payment (e.g. email address, payment or bank account details) is transmitted directly to Stripe and processed there. The payment methods available depend on the options offered by Stripe and activated by CONTRIMA at any given time. Please note: We do not store any bank details in our systems ourselves. We merely record the amounts due and whether they have been paid.

When you make a payment by credit card, you will be asked to provide payment details (email address, credit card details). The data is transmitted directly to Stripe with a transaction ID and processed there. We only receive confirmation from Stripe that the payment has been made, as well as data necessary to link the payment to your account.
Depending on the payment method selected, the data required to process the payment (in particular your name, your billing and, where applicable, delivery address, your email address, the amount to be paid and order details, as well as your IP address (for fraud prevention and geolocation)) also transmitted to the respective payment service provider or other parties involved in the payment processing. Please note that these providers may, in some cases, also process personal data in countries outside the EU or the EEA. These providers base such data transfers on appropriate safeguards. The right to object applies only within the limits set out in Article 21 of the GDPR. Furthermore, our interests may preclude a cessation of processing, meaning that, despite your objection, we are still entitled to process your personal data. We will take any objection to direct marketing measures into account immediately and without further weighing up the existing interests.
